Boston Medical Group Telemedicine (“Boston Medical Group Telemedicine<\/b>,” “we<\/b> “, “us<\/b>“, or “our<\/b> “), owns and operates www.bostonmedicalgroup.com (“Website<\/b>,” and collectively with any affiliated mobile application (“App<\/b>“), the (“Site<\/b>“). \u00a0The Site is intended to facilitate the provision of the Service to registered users. \u00a0The “Service<\/b>” includes (i) providing individuals with information on health care and wellness (“Content<\/b>“); (ii) development and gathering of health care records and health care information with retention of the same for use in health care provider appointments and communications; (iii) administrative support in connection with scheduling and payment for health care provider services; and (iv) telecommunications support for using the Service as a means of direct access to healthcare providers provided by Boston Medical Group Telemedicine and similar affiliated professional entities for communication, consultations, assessments, and treatment by such health care providers.<\/p>\n

SPECIAL CONSENT TO ONLINE HEALTH SERVICES<\/b><\/p>\n
Online Health Services \u00a0involves the delivery of healthcare services using electronic communications, information technology, or other means between a health care provider and a patient who are not in the same physical location. \u00a0Online Health Services may be used for diagnosis, treatment, follow-up and\/or patient education, and may include, but is not limited to:<\/p>\n
The electronic systems used in the Boston Medical Group Telemedicine Service will incorporate network and software security protocols to protect the privacy and security of health information and imaging data, and will include measures to safeguard the data to ensure its integrity against intentional or unintentional corruption.<\/p>\n

The Privacy Policy<\/a> is hereby incorporated into these Terms of Use by reference and constitutes a part of these Terms of Use.<\/p>\n By submitting forms on this site, or verbally agreeing to receive communications, you explicitly allow Boston Medical Group Telemedicine to contact you via SMS (texts) from (619) 775-4456, or emails, with information and offers. You can be removed from this opt-in or deleted from the company database by replying “STOP” to any SMS or email.<\/p>\n YOUR RELATIONSHIP WITH Boston Medical Group Telemedicine<\/b><\/p>\n Boston Medical Group Telemedicine provides a platform for you to consult with a health care provider affiliated with Boston Medical Group Telemedicine or similar affiliated professional entity and obtain access to additional information, which you may or may not choose to utilize in planning your health care and wellness. \u00a0The health and wellness resources made available through our Service are not a substitute for direct in-person health care services in all cases. The decision to focus on diagnosis, treatment recommendations, or both rests with you and the health care provider. You understand that by coordinating and in certain cases consulting with Boston Medical Group Telemedicine or affiliate health care provider through the Service, you are not entering into a provider-patient relationship with Boston Medical Group Telemedicine.<\/p>\n By accepting the Terms of Use, you understand that a health care provider may send you messages, reports, and emails via the Service regarding the treatment of your condition or in response to your inquiry. \u00a0It is your responsibility to monitor these messages, reports, and emails. You agree that you will not hold us liable for any loss, injury, or claims of any kind resulting from your failure to read these messages or for your failure to comply with any treatment recommendations contained in these messages.<\/p>\n CONSULTATIVE SERVICE<\/b><\/p>\n In some cases, Boston Medical Group Telemedicine or affiliated health care provider may use the Service to provide advice or treatment to you. \u00a0A healthcare provider consulting with you through the Service may not have the benefit of information that would be obtained by examining you in person and observing your physical condition, in each instance. \u00a0Therefore, the health care provider may not be aware of facts or information that would affect his or her opinion of your diagnosis. To reduce the risk to you of this limitation, Boston Medical Group Telemedicine strongly encourages you to provide all relevant information and discuss all diagnosis and treatment options with a health care provider. \u00a0Moreover, a health care provider utilizing Boston Medical Group Telemedicine may be limited by state law in prescribing certain medications to you without first conducting an in-person physical examination. By deciding to engage the Services, you acknowledge and agree that you are aware of these limitations and agree to assume the risk of these limitations. \u00a0Furthermore, you agree and accept that: (i) the diagnosis you will receive is limited and, in some cases, provisional; (ii) the health care services are not intended, in all cases, to replace a full medical evaluation or an in-person visit with a health care provider; (iii) a health care provider acting through the Service may not have important information that is usually obtained through a “hands-on” physical examination; and (iv) the absence of a physical examination may affect the health care provider’s ability to diagnose your condition, disease or injury.<\/p>\n SITE CONTENT<\/b><\/p>\n Other than the personalized content we send you through an in-App message, you should not consider Content on the Site to be medical advice.<\/p>\n REGISTRATION AND USER ACCOUNTS<\/b><\/p>\n You are obligated to register with Boston Medical Group Telemedicine in order to access the Service, although certain pages of the Site are accessible by any individual and subject to the Terms of Use available on the Site. \u00a0However, the Service is available only to users who have registered with Boston Medical Group Telemedicine or other persons affiliated with Boston Medical Group Telemedicine who have been granted accounts with usernames and passwords (“Secure Users<\/b>“). \u00a0If you are a Secure User, you agree to accurately maintain and update any information about yourself that you have provided to Boston Medical Group Telemedicine. \u00a0If you do not maintain such information, or Boston Medical Group Telemedicine has reasonable grounds to suspect as much, Boston Medical Group Telemedicine has the right to suspend or terminate your account and your use of the Service. \u00a0You also agree to immediately notify Boston Medical Group Telemedicine of any unauthorized use of your username, password or any other breach of security that you become aware of involving or relating to the Service by emailing Boston Medical Group Telemedicine at usa@www.bostonmedicalgroup.com. Boston Medical Group Telemedicine reserves the right to take any and all action, as it deems necessary or reasonable, regarding the security of the App and your Secure User account.<\/p>\n You agree to keep in confidence your username and password and to exit from your Secure User account at the end of each session. \u00a0You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You are responsible for changing your password promptly if you think it has been compromised. \u00a0You may not transfer or share your password with anyone, or create more than one account. Creating more than one account substantially limits our ability to provide appropriate care. Boston Medical Group Telemedicine explicitly disclaims liability for any and all losses and damages arising from your failure to comply with this section. You may not use anyone else’s account at any time.<\/p>\n ‘JAILBREAKING’ THE MOBILE OPERATING SYSTEM<\/b><\/p>\n The App is intended for use only on a mobile phone that runs an unmodified manufacturer approved operating system. \u00a0Using the App on a mobile phone with a modified operating system may undermine security features that are intended to protect your protected health information from unauthorized or unintended disclosure. \u00a0You may compromise your protected health information if you use the App on a mobile phone that has been modified. Use of the App on a mobile phone with a modified operating system is a material breach of these Terms of Use.<\/p>\n ACCESS RIGHTS AND PROHIBITED USE<\/b><\/p>\n We hereby grant to you a limited, non-exclusive, nontransferable right to access the App in the States Where We Operate and to use the Service solely for your personal non-commercial use and only as permitted under these Terms of Use, Consent to Online Health Services, and the Privacy Policy<\/a>. \u00a0We reserve the right, in our sole discretion, to deny or suspend use of the App to anyone for any reason. You agree that you will not, and will not attempt to: (a) impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity; (b) use the App to violate any local, state, national or international law; (c) reverse engineer, disassemble, decompile, or translate any software or other components of the App; (d) distribute viruses or other harmful computer code through the App’ or (e) otherwise use the App in any manner that exceeds the scope of use granted above.<\/p>\n OWNERSHIP OF INFORMATION SUBMITTED VIA THE SITE<\/b><\/p>\nNo Contact\/ No Usage<\/u><\/h3>\n
